SJR 5 has been referred to the Full Joint Sate Agencies Committee. The Arkansas Bar Association as well as Arkansas Trial Lawyers Association believes strongly that this measure will: destroy the balance between the three branches of government; hand lobbyists the keys to the courtroom, creating an unstable economic development environment and politicizing our courts; strip language from our Constitution that has been in place since 1874, devastate our 7th Amendment Constitutional Rights (Just as we protect our 2nd Amendment Rights, we must protect the 7th); and creates public policy that essentially says the lives of our children – born and unborn – as well as stay-at-home moms and senior citizens who are abused or killed have little or no value.
The Arkansas Department of Finance and Administration has also provided a legal analysis which echos these sentiments. According to the DF&A Legal Analysis, “The proposal would alter the balance of power between the branches of government.” The report goes on to say that SJR will endanger our protections embodied in the 7th Amendment.
